Greg Melton lost his election this year after serving as Carter County Sheriff for eight years.
Melton committed suicide on October 16 and lost this November's election by only two votes.
According to Secretary of State's Communication Director Ryan Hobbart a candidate can challenge an election if there is less than one percent difference in the vote.
A deceased person cannot contest the results.
Deputy Sheriff Ted Reynolds has been sworn in until the Sheriff-elect Tommy Adams takes over in January.
Melton's name was not taken off the ballot because it was too close to election day.
